Terms of Use
Ember ("the App") is developed by Benjamin Jacquet, trading as Novaire Digital (ABN 24 349 309 268) ("we", "our"). By using the App you agree to these terms. The App is also licensed to you under the standard end user licence terms of the store you downloaded it from (for the App Store, Apple's Licensed Application End User License Agreement).
1. The App
Ember guides a monthly conversation ritual for couples, with conversation cards, a record of decisions and a private Vault. It is a tool for connection, not counselling or therapy, and nothing in it is professional, medical or legal advice. If your relationship involves fear, control or violence, please reach out for support: in Australia, 1800RESPECT on 1800 737 732, and 000 in an emergency.
2. Adults only
You must be 18 or over to use Ember. Some cards and the Vault deal with intimacy between consenting adults. The App asks both partners to confirm that they are 18 or over before the after-dark round and before the Vault. The after-dark round only appears when you both want it.
3. Ember Plus subscription
The monthly ritual is free. Ember Plus is an optional auto-renewing subscription, sold monthly or yearly at the price shown in the App before you buy, in your store's currency. In Australia the current prices are A$14.99 a month and A$59.99 a year; the price your store shows when you buy is the price that applies. There is no free trial. Payment is taken by Apple or Google when you confirm the purchase. The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends; you can manage or cancel it at any time in your App Store or Google Play account settings. One subscription covers both of you on the phone you use together. Refunds are handled by Apple or Google under their policies, and nothing in these terms limits your rights under the Australian Consumer Law.
4. Your content
Everything you write in Ember belongs to you and stays on your phone (see the privacy policy). Because we hold no copy, we cannot recover it for you. In particular, a forgotten Vault PIN can only be reset by erasing that partner's side, and the Vault cannot be moved to a new phone. Keep that in mind before you rely on Ember to store anything you cannot afford to lose.
5. Acceptable use
Use Ember only with a partner who has agreed to use it with you. Do not use it to pressure, monitor or deceive anyone, and do not try to open another person's side of the Vault. Do not copy, resell or reverse engineer the App or its content except where the law allows.
6. Third-party services
Purchases are processed by Apple or Google and verified through RevenueCat, Inc. Their own terms and privacy policies apply to those services.
7. Disclaimers and liability
We work hard to make Ember reliable, including its reminders, but notifications ultimately depend on your phone's settings and operating system. The App is provided as is, without warranties beyond those that cannot be excluded under the Australian Consumer Law. To the extent the law permits, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid for Ember Plus in the twelve months before the claim.
8. Changes
We may update the App and these terms. Material changes will be reflected on this page with a new date above. Continuing to use the App after a change means you accept the updated terms.
9. Governing law
These terms are governed by the laws of Australia. Disputes are subject to the non-exclusive jurisdiction of the Australian courts.
